1. Contract
A contract between Saal Digital Corporation (Saal-Digital) and the customer for the manufacture of photographic products is concluded if Saal-Digital receives the order via the Design Software, the online store or the app and accepts the contract within 5 days by sending an order confirmation. In addition, a shipping confirmation will be sent.If the customer is an entrepreneur, a legal entity under public law or a special fund under public law, the registered office of Saal-Digital is agreed as the place of jurisdiction.If the customer is a consumer, the statutory places of jurisdiction apply; mandatory consumer places of jurisdiction as well as mandatory consumer protection provisions of the state in which the customer has their residence or habitual residence remain unaffected.The information in our privacy protection policy applies.
2. Prices, terms of payment
The fee to be paid by the customer to Saal Digital for the production of photographic products shall be determined by the prices of Saal Digital applicable at the time the contract is concluded. Unless otherwise stated, prices include VAT. Shipping costs are additionally calculated according to product group and destination.
3. Delivery and place of performance
Saal-Digital delivers the photo products to the delivery address specified in the order. Shipping costs are charged for the delivery. The amount of the shipping costs will be communicated to the customer during the order process.Deliveries are made only to countries that can be selected as delivery countries during the order process. If, in individual cases, additional taxes, duties or fees are incurred which are not already shown during the order process or assumed by Saal-Digital, these shall be borne by the customer.Saal-Digital is entitled to make partial deliveries, provided that these are reasonable for the customer. Any additional costs arising from this shall be borne by Saal-Digital.In relation to entrepreneurs, legal entities under public law and special funds under public law, the place of performance is the registered office of Saal-Digital.In relation to consumers, the statutory provisions apply.
4. Payment
The photo products remain the property of Saal Digital until full payment has been received. Payment shall be made exclusively cashless, in the method of payment specified by the customer when placing the order. Invoices are sent exclusively as PDF documents by e-mail.
5. Vouchers & Promotions
Unless otherwise stated in the applicable conditions, the following applies to all vouchers and promotions: Vouchers cannot be combined with other promotions or vouchers. Discounts from vouchers and promotions do not apply to shipping costs and may only be usedonce per person and per household. Vouchers cannot be used to purchase gift vouchers. Vouchers have no cash value.
6. Gift vouchers
This voucher cannot be split between several orders. The minimum order value is therefore the voucher value. The shipping costs are excluded. You can redeem the voucher in the Saal Design Software, our webshop or our app. For technical reasons, only one voucher can be redeemed per order.
7. Right of cancellation
There is no right of cancellation for contracts for the delivery of goods that are made according to customer specifications or are clearly tailored to personal needs. This applies in particular to individually designed photographic products.
8. Liability
8.1 General liability
Saal-Digital shall be liable without limitation in accordance with the statutory provisions for damages arising from injury to life, limb or health as well as in cases of intent.Liability under the Product Liability Act remains unaffected.
8.2 Liability towards consumers
Liability towards consumers in the event of negligent causation of damage is governed by the statutory provisions.
8.3 Liability towards entrepreneurs
In relation to entrepreneurs, legal entities under public law and special funds under public law, Saal-Digital shall be liable in cases of slight negligence only in the event of a breach of material contractual obligations and only for direct, typical and foreseeable damage.In cases of gross negligence, Saal-Digital shall also be liable in relation to entrepreneurs, legal entities under public law and special funds under public law only for direct, typical and foreseeable damage, insofar as this is legally permissible.In relation to entrepreneurs, legal entities under public law and special funds under public law, liability for indirect damage, consequential damage, loss of profit, lost savings, production downtime, business interruptions, reputational damage or other atypical damage is excluded, insofar as this is legally permissible.The above limitations of liability do not apply in cases of intent, to damages arising from injury to life, limb or health, or insofar as liability cannot be excluded or limited under mandatory statutory provisions.
9. Complaints/dispute resolution
We prefer to clarify your concerns directly with you and therefore do not participate in consumer arbitration procedures. 10. Image Files
The Customer shall provide only copies of their image files for the production of photo products and shall be responsible for securely backing up the original files. This applies regardless of whether the files are submitted through a customer account or without an account as part of an order.
